These terms are an agreement between you and Malört Meter ("we", "us"). Malört Meter is an independent project. By creating an account, logging in or using malortmeter.com, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site.
You log in with a one-time code we text to your number (see the SMS terms). Keep your phone secure: anyone who can read your texts can log in as you. You're responsible for what happens on your account. If you lose your number or think someone else got in, use "Log out everywhere" in the app and contact us.
"Your content" means what you submit: prices, bars you add, tags, your display name, crew names, claims, flags and messages.
Don't:
We may review, hide or remove any content, reset or remove points, badges and streaks, or suspend or ban accounts, at our discretion, with or without notice. That includes doing so based on members' flags. We don't have to monitor what people post, and we aren't responsible for content posted by others.
Points, ranks, badges, streaks, crews and leaderboards are just for fun. They have no cash value. You can't sell, transfer or redeem them for anything, including drinks. We can change how they work, or reset them, at any time.
Any contest or promotion we run is governed by the Official Contest Rules plus the description shown in the app for that contest. No purchase and no drink is ever necessary to enter or win. Prizes never include alcohol.
Only claim a bar if you own it or are authorized to act for it. Any prices, specials or notes you give us for your listing must be accurate, and you're responsible for honoring them and following liquor laws. We may approve, decline or remove a claim or verification at our discretion. A verified listing doesn't make you our partner or give you control over members' reports.
Prices and the Price Index are provided for information and fun only. They may be wrong or outdated (see the Disclaimer). You may quote and cite them with attribution to "Malört Meter Price Index (malortmeter.com)". Data downloads that include bar names and locations from OpenStreetMap stay under the Open Database License.
Malört Meter relies on other services, including map tiles, text messaging, analytics, push notifications and hosting. It may also link to other sites. We don't control them and aren't responsible for them, and their own terms and privacy policies apply.
What you drink, where you go and how you get home are your decisions. Malört Meter doesn't sell or serve alcohol and isn't responsible for your drinking, for what bars serve or charge you, or for anything that happens at a bar or on the way. Don't use the app while driving. Drink responsibly and never drink and drive.
Malört Meter is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy and uninterrupted or error-free availability.
To the fullest extent permitted by law, Malört Meter and the people who run it won't be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill, or for any injury, illness or loss related to drinking alcohol or visiting any bar, arising from or related to your use of Malört Meter, even if we were told they were possible. Our total liability for any claim related to Malört Meter is limited to the greater of $50 or the amount you paid us in the 12 months before the claim (Malört Meter is free).
Some places don't allow some of these limits. In those places, they apply only as far as the law allows.
To the extent permitted by law, you agree to defend, indemnify and hold harmless Malört Meter and the people who run it from any claims, losses and costs (including reasonable attorneys' fees) arising from your content, your use of Malört Meter, or your breaking these terms or the law.
You can delete your account anytime from Me → Delete account. We may suspend or end your access at any time, for any reason, including breaking these terms. Sections 3 (the license for content already posted), 6 and 9 through 17 survive after your account ends.
These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules. If you have a problem, please contact us first. Most issues get sorted out quickly. If we can't resolve a dispute informally within 30 days, it will be decided exclusively in the state or federal courts located in Cook County, Illinois, and you and we consent to their jurisdiction. Either of us may bring an individual claim in small-claims court instead.
We may update these terms. We'll change the date at the top, and for meaningful changes we'll let you know in the app. If you keep using Malört Meter after an update, you accept the new terms.
These terms, the Privacy Policy, the SMS terms and any contest rules are the whole agreement between us about Malört Meter. If any part is found unenforceable, the rest still applies. If we don't enforce something right away, we haven't waived it. You can't transfer these terms. We can, for example if the project changes hands. Questions: the contact form.
